Welcome to the Brazilian Hairtech Australia website. Please read the following terms and conditions carefully before using this site or placing an order.

Brazilian Hairtech Australia operates this site and makes it available to you subject to these terms and conditions, our Privacy Policy, and any other policies published on the site from time to time. Together, these documents form the complete agreement between you and Brazilian Hairtech Australia and are referred to throughout as the Terms and Conditions.

By accessing or using the site, including applying for a trade account or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree, please leave the site immediately.

These Terms and Conditions apply to customers with an Australian delivery address only.

1. Trade Accounts and Account Eligibility

This site is a business to business wholesale platform. It is available exclusively to professional salon operators and qualified hairdressers operating a legitimate salon business in Australia. By applying for a trade account, you confirm that you are operating as a business and that all products ordered through this site are for professional use within your salon or for retail sale from your salon premises.

Brazilian Hairtech Australia reserves the right to approve or decline any trade account application at its sole discretion, without being required to provide a reason. Account access may be suspended or terminated at any time if you breach any aspect of these Terms and Conditions.

To create and maintain a trade account, you must provide accurate, current, and complete information at all times. You are solely responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. If you become aware of any unauthorised use of your account, you must notify us immediately at admin@brazilianhairtech.com.au.

2. Products and Pricing

All prices displayed on the site are in Australian Dollars and exclude GST unless otherwise stated. GST and any applicable freight charges will be calculated and displayed at checkout prior to order confirmation.

Brazilian Hairtech Australia reserves the right to update or amend product pricing at any time without prior notice. The price applicable to your order is the price displayed at the time you submit your order.

While we take care to ensure product descriptions, images, and specifications on the site are accurate, we do not warrant that all content is free from errors or omissions. Product packaging, formulations, and specifications may vary from those displayed on the site from time to time.

3. Orders

By submitting an order through the site, you are making an offer to purchase the products selected at the price displayed, subject to these Terms and Conditions. A binding contract between you and Brazilian Hairtech Australia is formed only once we have confirmed acceptance of your order in writing.

You will receive an order confirmation by email upon acceptance. If you do not receive confirmation within 24 hours of placing your order, please contact us at admin@brazilianhairtech.com.au. Brazilian Hairtech Australia reserves the right to cancel or decline any order at its discretion, including where a product is no longer available or where an error in pricing or product information has occurred. In such cases, a full refund will be issued promptly.

Order details cannot be amended once an order has been placed. Please ensure all delivery information is accurate and complete before submitting. Brazilian Hairtech Australia accepts no responsibility for delays or failed deliveries resulting from incorrect or incomplete delivery details provided by the customer.

4. Payment

Payment for all orders must be made in full at the time of ordering. Brazilian Hairtech Australia accepts payment via Shopify Payments and bank transfer or electronic funds transfer. Payment must be cleared and received before any order is dispatched.

For bank transfer payments, order dispatch will be held until funds have cleared into our account. Banking details will be provided on your invoice. If payment is not received within 3 business days of the order date, the order may be cancelled.

All transactions are processed using secure payment technology. Brazilian Hairtech Australia does not store credit card details on its systems.

5. Delivery

Products are available for delivery within Australia only. Brazilian Hairtech Australia dispatches orders placed before 2:00pm AEST on the same business day via StarTrack Australia. Orders placed after 2:00pm AEST or on weekends and public holidays will be dispatched on the next business day.

Delivery timeframes are estimates only and are subject to the carrier’s network. Brazilian Hairtech Australia accepts no liability for delays once an order has been dispatched. Risk in the products passes to you upon dispatch. Title to the products passes to you once payment has been received and cleared in full.

Delivery charges are calculated at checkout based on your location and order weight. For full details please refer to our Delivery Policy.

6. Returns and Cancellations

Once placed and accepted, an order may be cancelled only prior to dispatch. To request a cancellation, contact us immediately at admin@brazilianhairtech.com.au. Brazilian Hairtech Australia will make reasonable efforts to accommodate cancellation requests received before an order has been picked and packed, but cannot guarantee cancellation once processing has begun.

For returns of damaged, faulty, or incorrectly supplied products, please refer to our full Returns Policy. Brazilian Hairtech Australia does not accept returns for change of mind on professional wholesale orders.

Nothing in these Terms and Conditions excludes or limits any rights you may have under the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

7. Resale and Authorised Use of Products

Products supplied by Brazilian Hairtech Australia are intended for professional salon use or retail sale from your salon premises only. You must not resell or redistribute products through any online marketplace, third party website, or unauthorised channel without the prior written consent of Brazilian Hairtech Australia.

If you wish to sell Brazilian Hairtech products through your own website or any online platform, you must contact us at admin@brazilianhairtech.com.au to discuss an authorised online reseller arrangement before doing so.

Brazilian Hairtech Australia takes the diversion of professional products seriously. If you become aware of any unauthorised sale or distribution of products, please notify us promptly.

8. Intellectual Property

All content on this site, including but not limited to the Brazilian Hairtech brand name, logos, trade marks, product names, images, copy, and system names including Copacabana, Ipanema, and Ultimate Healing, are the intellectual property of Brazilian Hairtech or its parent company Brazilian Hairtech International and are protected under Australian and international intellectual property law.

You may not reproduce, distribute, modify, or use any content from this site for any commercial purpose without the prior written consent of Brazilian Hairtech Australia. A limited, non exclusive, non transferable licence is granted to approved stockists to use Brazilian Hairtech marketing materials solely for the purpose of promoting the products within your salon and through your authorised channels, in accordance with any brand guidelines provided.

9. Limitation of Liability

To the maximum extent permitted by law, Brazilian Hairtech Australia excludes all liability for any indirect, special, incidental, or consequential loss or damage arising in connection with your use of this site or the purchase of products, including loss of profits, loss of revenue, or loss of business opportunity.

Brazilian Hairtech Australia’s total liability to you for any claim arising under these Terms and Conditions, whether in contract, tort, or statute, is limited to the value of the relevant order giving rise to the claim.

Nothing in these Terms and Conditions excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.

10. Privacy

Brazilian Hairtech Australia is committed to protecting your personal information and handles all personal data in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy is incorporated into and forms part of these Terms and Conditions.

11. Third Party Sites

This site may contain links to third party websites for your convenience. Brazilian Hairtech Australia is not responsible for the content, accuracy, or privacy practices of any third party site and does not endorse any third party products or services. Accessing any third party site is entirely at your own risk.

12. Amendments to These Terms

Brazilian Hairtech Australia may update these Terms and Conditions at any time by publishing the revised version on the site. Changes take effect immediately upon publication. Your continued use of the site following any changes constitutes your acceptance of the updated Terms and Conditions. We recommend reviewing this page periodically.

13. Governing Law

These Terms and Conditions are governed by the laws of New South Wales and you agree to submit to the non exclusive jurisdiction of the courts of that state in relation to any dispute arising under these Terms and Conditions.
